Postscript 2015: Putting myself in the crosshairs of Congressman Fitzpatrick’s (PA-8) political machine was not fun. For the record, I endured it for the same reason I stood in front of the US Supreme Court and Capitol in Washington D.C. for 5 months (here and here).
PEOPLE WERE DYING trying to access healthcare. I had been witnessing the suffering with every portrait and story in my Healthcare in the US painting series. I couldn’t un-know the suffering. Another medical bankruptcy. Another person worrying herself to sleep about insurance covering a hospital bill. Another death. I knew way more than most. My congressman was trying to overturn the Affordable Care Act, Obamacare, a law that would help so many. His incendiary –and often incorrect — rhetoric was in lockstep with his party line. Knowing what I knew was happening to real people, was I going to remain silent? I thought good ol’ American town halls were the way to go. What better place for constituents to interact directly with their representatives? I was sure.
This was not going to be easy. I got such a runaround from Congressman Fitzpatrick’s staff when I asked for the town hall schedule. Major red flag. Why? “You don’t know a week in advance if the congressman is having a town hall?” The staff gave their parrot responses. “I can tell you there is no town hall scheduled today.” That’s it? What the hell is going on? I never attended a town hall before I started advocating for the Affordable Care Act.
This is weird. I just wanted to show up, and talk about my congressman’s opposition to the Affordable Care Act, a law he had been publicly vilifying. He had also been pounding the healthcare law on his Facebook page. He was our congressman, after all…making outrageous statements. Why can’t I know about the town hall schedule? Because I would challenge him to talk about what is really in the healthcare law? What? He’s a politician. Politicians get challenged all the time. What is he hiding? OK. This is weird.
My countermove. If the congressman’s staff wasn’t going to give me a straight answer, I would call them everyday. They would either have to lie or tell me the truth. My congressman had been having town halls. I kept reading about them in the newspaper. And I could never get a schedule? Or a least a week’s advance notice? In the beginning, I had to call EVERY DAY, and I could only get town hall info for THAT day. I, and all of PA-8’s constituents, were being played. WHAT was going on? My daily calling continued. Ball in their court.
After a few months of daily calling, and watching the staff have a meltdown precipitated by the simple request for a town hall schedule, I confirmed for myself that something more was going on. My straightforward desire to advocate for a law turned into a civics exercise.
Jeesh…I was too busy for this. At the time I was continuing to interview subjects for Art As Social Inquiry’s healthcare painting series. I launched the ASI How We Die painting series. I was working with PA Health Access Network by giving talks about the Affordable Care Act. And I still had to paint the paintings. I was doing stuff. The last thing I wanted or expected was to get into a cat and mouse game with my congressman.
The congressman and his staff doubled-down. Town halls ceased. I had to justify the time I was putting into tracking town halls that were not happening. After the runaround I was getting, I came to so distrust my representative. I really understood why Congress was polling as less popular than cockroaches. If I stopped logging town halls, I half believed my Congressman was sneaky enough to schedule a town hall, stack the audience as best he could, get the photo-op without his positions really being challenged. Disgusted and disheartened by the antics, I just kept calling. By the end of the first year, I gave myself daily pep talks to see this tap dance through to the end whatever that looked like. “He’s lying about the Affordable Care Act, and PEOPLE ARE DYING,” I thought. And he will not be held to account in public.
I turned the time I spent logging town halls (or lack of them) into this art project, Tracking Town Halls: Do Unscripted Constituent Public Gatherings Matter? It was the only way I could justify the time I was spending.
I tracked town halls for 2 years. It was clear that the congressman was NOT going to position himself where he could be engaged substantively.Period. Why? Only he really knows. Phobia? Insecurity? Did he not do his homework on the issues? What was he so afraid of?
Our tete a tete culminated with me complaining to the local newspaper about the congressman not having town halls. The newspaper printed an unflattering article, the truth. 24 hours after publication all traces of the article were scrubbed from online sources. When I confronted the newspaper about the disappearing Fitzpatrick article, they said they had “evidence” the article was not factual. The piece was written by a longtime, well-respected jounalist. (My tech guys pulled the article out of the “cache” before it disappeared. I posted it on my website. ) The The Congressman is suspected of having had a hand in squelching free press based on what I believe is a bogus video provided by him and his staff as “proof” the newspaper article was not factual. (Commentary in log below.)
When the press is coerced by outside forces to self-edit, we have a BIG problem. What is democracy without a free press? Newspapers print — or don’t print –what the politicians say?
How about it, Congressman, did you provide video evidence, or ANY kind of evidence that the uncomplimentary newspaper article was wrong. And can we all see it this evidence? After all, there are questions the press self-censored because of this so-called evidence. Pretty big deal in a free society when the press is strong-armed into removing an article. We will never know for sure unless the parties involved come clean. I believe someday they will. A very respectable journalist had his reputation besmirched in the process. A wrong needs to be righted.
I never had the chance to ask the Congressman directly if he pressured the local press into removing the uncomplimentary story. Town halls had ceased. Real public discourse was shut down. But the Congressman’s PR front powered on. We saw lots of visits to businesses. What employee was going to challenge the congressman at his job?? The congressman had successfully gagged challengers, and quite possibly the press.
You see just how far things went.
In my book-in-progress,I describe the congressman’s subtle moves to try to derail someone he saw as a political combatant. I, on the other hand, saw myself as an advocate for the healthcare law, one who unwittingly unmasked a politician who was faking it. And if the public had found out, they might have given him the boot. I tracked town halls for 2 years until the 2014 elections because #1 Congressman Fitzpatrick spewed every foul misrepresentation of the healthcare law like a good GOP foot soldier. #2 PEOPLE WERE DYING and needed the healthcare law. #3 Constituents in PA-8 deserved a representative who actually stood for something, and could ARTICULATE his positions. Instead they had a Manchurian candidate who ran a masterful PR campaign, and won on it.

SOMETHING IS AMISS IN PA CONGRESSIONAL DISTRICT 8
Tracking Town Halls: Do Unscripted Constituent Public Gatherings Matter? I started this log in 2012 because I wanted to attend as many town halls as possible to challenge my congressman’s egregious politicking around the Affordable Care Act (Obamacare). I also could not get a straight answer from Rep. Fitzpartrick’s staff about when town halls were scheduled.
UNMASKING, “FREE” PRESS, WHAT’S GOING ON?
It’s now August 2014, 2 years after the start of the town hall log. Congressman Fitzpatrick has had zero town halls this August, the usual time for representatives to meet constituents in unscripted town hall forums.
UNMASKING. It didn’t take long to figure out the congressman did not want me at town halls. Or anybody else who might challenge him. I concluded Rep. Fitzpatrick was on one long press junket doing lots of controlled public appearances but no town halls. He certainly did not want to interact with constituents where he would need to explain his votes and positions with more than canned talking points. Town halls dried up until August 2013.
THEN two town halls happened that the Congressman’s staff did not tell me about — 8/2/2013 in Springtown, PA, and 8/4/2013 in Salford Twp., PA. Why would the congressman and his staff not share info about public gatherings? He really didn’t want very many people to know about them?
Now the story gets complicated.
“FREE” PRESS? I complained to my local newspaper, The Intelligencer, that I could not get information about town halls. The newspaper put a well respected, veteran reporter on the story. The article was not complimentary to Congressman Fitzpatrick. Within 24 hours the story was wiped clean from the internet. Why? The newspaper told me there were “inaccuracies.” No details. No corrections issued the next day. Wholesale deleting of an article. Why?
I only discovered the article was wiped from the internet when I went to show it to my husband the day after it was printed in the newspaper. Tech gurus advised me the article might still be in the “cache,” and set out to retrieve it before it completely disappeared. Read the deleted article here.
WHAT’S GOING ON? “Inaccuracies,” we’re told. The newspaper had video to prove it, I was told — video proving Congressman Fitzpatrick was having town halls thereby making the uncomplimentary article “inaccurate?”
Let me guess. Don’t advertise there are town halls. Don’t let constituents know who want to go. Target a small group. Hope a few, targeted people show up. (Even send out emails to the “friendly” folks for good measure, maybe?) Get video of somebody holding the mic. Presto, evidence!
What is this “evidence” that caused a newspaper to kill an article? And did our congressman manufacture the evidence and pressure the newspaper to delete the article?
#1 Let’s see the video, know when and where it was taken, and end suspicion once and for all that Rep. Fitzpatrick had anything to do with strong-arming the press to censor itself and remove an article.
#2 Other representatives have town halls, post the schedules on their websites. My congressman has made an issue of town halls where none should exist. Why?

Please note: Unfortunately, information about ALL town halls has not been forthcoming from the Bucks County office. Several have been held, but information about them was not given. I regret to say that this log may become a record of town halls the congressman and his staff did not want constituents (or this constituent) to know about. I hope to reestablish the reliability of this log by finding a way to get accurate information.

UPDATE 4/2014 After 5 months, I have decided to no longer record Rep. Fitzpatrick’s appearances. My suspicions have not changed in all that time. Here is what I wrote in October 2013:
It has been pointed out to me by Congressman Fitzpatrick’s communication’s director that the Congressman is “accessible.” He keeps a very busy schedule, I am told, meeting with constituents and groups at private gatherings and public appearances such as expos, ribbon cuttings, community events. I am happy to post those on this log as well. I contend, however, that these gatherings, while commendably serving those involved, do not exempt the congressman from having many, well publicized town halls where his votes and positions are challenged for the benefit of all to hear. Without opportunities for ALL constituents to be heard in healthy public discourse, these community service appearances could be construed as PR events from a representative who is always campaigning

The election seems a natural conclusion to this two year tracking town hall project.
An essay will follow shortly. I will share in depth what I have learned. Sadly, after a two year study of constituent interaction, I have to report that our congressman is a master of photo-ops and rehearsed one-liners delivered with practiced conviction that can carry a headline. He is either incapable or unwilling to engage constituents at unscripted events where he would have to expound on his statements, and explain his voting record.
10/28/2014 KEVIN STROUSE TOWN HALL YES Kevin Strouse, Democratic candidate running against Mike Fitzpatrick had a REAL TOWN HALL last night. He took questions from the audience for 1 1/2 hours. There were no restrictions, no pre-screened questions. Constituents could speak up in their own words.Mr. Strouse promised many town halls as a congressman. He emphasized transparency and dialog about the tough issues.

Would the Congressman continue to vote against the Affordable Care Act if he knew doing so would harm this little girl he posed with in the picture? Congressman Fitzpatrick is a member of the Rare Disease Caucus. The congressman has voted 50 times to repeal the healthcare law.BUT the healthcare law BANS annual and lifetime limits that bankrupted many families AND gives insurance to many millions, thousands of whom may have rare diseases that might have gone untreated without the new law.

No town hall info to report today because I can’t get it. My hope was to get confirmation about this week’s (and month’s) town hall schedule since the House of Representatives is in recess this week. My fear is that if I don’t call, a real town hall will happen and I will have missed my opportunity to challenge my congressman on his misstatements on Obamacare.Three people die every hour because they cannot access healthcare. I want to hear how he squares that with his votes in Congress and the policies he advocates. I’d like to publicly address my congressman at a town hall where the questions are from real people and the dialog is unscripted.That is why I keep this log. I keep it for Billy Koehler who died slumped over the steering wheel of his car because he lost his insurance and needed care. I do it for Courtney Leigh Huber who cut back on her insulin trying to save a little money because she was uninsured. She went into a diabetic coma and died. I do it for my children and pray to God they never find themselves in such dire circumstances. And if they ever did, I pray somebody will speak for them.It may be a game to the congressman’s staff to take my phone number and politely say they will pass the message to Pat. And then Pat never returns my call because her job is, after all, as a radio talk show host . And why should she bother returning this constituent’s call? No one was available in the office to tell me if there is a town hall today or in the future. I called Pat’s number twice between 9:30 AM and 10:30 AM in an effort to get timely info about town halls for the log today. No answer.I apologize to followers of this log for information. None provided today. A fellow constituent (Clare) posted on ASI’s FB page. She is a follower of this log. She called the congressman’s office in the afternoon about another matter, and also asked if there is a town hall today. The staff was able to give her the town hall information that they were unable to provide to another constituent (me) earlier this morning. The congressman sometimes has tele-“town halls,” robo-calling to random groups of constituents some of whom might get the chance to ask a question. The office said there is no way to notify constituents in advance. Also, there is also no way to jump on the call if one is in progress (from my own experience). Please contact the congressman’s office to know more about tele-“town halls” and to get on a call-list. 10/2014 As I near the end of this project, I am filling in the log with my personal notes: Before the congressman spoke, he pulled the pastor aside. The pastor then went to the mic to admonish anyone who might want to be a “troublemaker.” Hmmm, I think that’s interesting. This congressman is really afraid of speaking to people who disagree with him. I ask about letting Medicare negotiate drug prices. I don’t feel I am in a public forum, but rather a guest at the Church. This isn’t a real town hall. But fine. Right after congressman’s talk, I approach someone from the church and ask if they would like a real presentation about the ACA. I team up with PA Health Access Network, and we schedule a presentation

I’m not even sure I got to asking about a town hall today because Kay was willing to have a conversation with me.
Kay said the town halls are on the website. “Really, when did that start to happen? I’ve been asking for that for months.”
She couldn’t tell me a lot because she was new.
She said she really didn’t understand why I would call so much. If I had something specific to talk about I could make an appointment.
I made the point that the congressman is using the press to give the appearance that he is having town halls. He gets his name in the paper for doing so. But it seems the notification process is designed to keep people from actually attending them. Real town halls are not being held for the benefit of ALL the constituents, it seemed.
I said “tele-town halls” were a sham and just another way control the dialog.
I explained that I want to ask very specific questions for the benefit of the public. Public, spontaneous exchanges are helpful to everyone. I said I think the congressman is very uncomfortable going off script. And he is trying to control public discourse. One starts to draw conclusions about the congressman’s motives. Why is this so hard — finding out about town halls?
I was asked several times what my issue was and I could make an appointment.
What is my issue?
This has become a First Amendment issue — one which I never expected or wanted, and I wish would just go away by having the congressman’s office publicize the town halls.
Why can’t we know about town halls in advance? Put the information on the homepage of the website in a timely manner and be done with it?
I asked Kay:
“Do I have the right to attend town halls?”
“Do I have the right to know about the town halls in advance so I can attend?”
“Yes”, she thought so.
I suggested that the congressman not have the town halls at all and take the heat for it if he wants.
She said she was new. She asked to take my number. I told her that I would appreciate somebody getting back to me. I pointed out that she took my number before and said somebody would get back to me and nobody ever did.
